These Terms and Conditions apply when you use shop.bmgift.co.uk or place an order with B&M GIFT (“we”, “us” or “our”). Please read them before ordering.
1. About us
B&M GIFT operates from 3 Floyer Grove, England, RG2 9UZ, United Kingdom. You can contact us at bmgiftltd88@gmail.com.
2. Products and personalisation
We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly between screens and finished items. For personalised products, you are responsible for checking names, wording, colours, layouts and other choices before submitting your order. We may refuse content that is unlawful, abusive, infringes another person’s rights or cannot reasonably be produced.
3. Orders and contract
Your order is an offer to buy. An automated acknowledgement confirms receipt but does not mean we have accepted it. A contract is formed when we send an order confirmation or begin production, whichever happens first. If we cannot accept an order, we will tell you and refund any amount paid.
4. Prices and payment
Prices are shown in pounds sterling and include applicable UK taxes unless stated otherwise. Delivery charges and the total price are shown before checkout. Payment is taken through the payment methods offered at checkout. You must be authorised to use the payment method supplied.
5. Delivery
Delivery options, charges and estimates are shown on the product page or at checkout. Personalised items may require production time before dispatch. Please see our Delivery Policy. Unless a different period is agreed with you, goods will be delivered without undue delay and within 30 days after the contract is made.
6. Cancellations and returns
For standard, non-personalised goods bought online, consumers normally have 14 days after delivery to tell us they wish to cancel, followed by 14 days to return the goods. Contact us at bmgiftltd88@gmail.com before returning anything. Unless the item is faulty or we agree otherwise, you are responsible for return postage. Where cancellation rights apply, we will refund the product price and the cost of standard outbound delivery within the time required by law.
The statutory right to cancel does not normally apply to goods made to your specifications or clearly personalised. Once production of a personalised order has begun, we may be unable to change or cancel it. This does not affect your legal rights if an item is faulty, not as described or otherwise does not conform to the contract.
Cancellation notice
To cancel a contract where the statutory cancellation right applies, email bmgiftltd88@gmail.com with your order number and a clear statement that you wish to cancel. You may use the following wording:
I/We hereby give notice that I/We cancel my/our contract of sale for the following goods: [insert order number and goods]. Ordered on/received on: [insert date]. Name: [insert name]. Address: [insert address]. Date: [insert date].
Nothing in these terms limits your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015.
7. Faulty or incorrect items
If an item arrives damaged, faulty, incorrect or not as described, contact us promptly with your order number and, where helpful, photographs. We will provide the remedy required by applicable consumer law, which may include repair, replacement, price reduction or refund.
8. Your use of the website
You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with the service, or use the customiser to upload unlawful or infringing content.
9. Intellectual property
The website, branding, product photography, software and original content belong to us or our licensors and may not be copied or commercially exploited without permission. You retain any rights you hold in content you submit, but grant us a limited licence to use it to create, fulfil, support and evidence your order.
10. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. Subject to that, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer.
11. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control. We will contact you where practical and take reasonable steps to minimise the effect.
12. Privacy
We handle personal information as described in our Privacy Policy.
13. Changes and severability
We may update these terms from time to time. The version in force when you order applies to that order. If any provision is found unenforceable, the remaining provisions continue to apply.
14. Governing law
These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the UK, you also retain any mandatory protections and rights to bring proceedings available where you live.
